Hi - I currently have my H1B(H4 for my wife) valid till Mar 2011 and EAD expires on 10/15/08.
Can I skip the renewal process for now and apply for EAD later?
My lawyer says it is OK to skip for now and apply for EAD/AP anytime as long as I-485 is pending.
Please advise.

Listen, everyone is frustrated but to take your lives for a GC is crazy. If you guys are so depressed please seek medical help. If you have kids they will be US citizens they can sponsor you 18 years later so why are you that frustrated. When your wife is on H4 that is the best time to have kids because she is at home and you don't have to pay daycare. It is the woman in H1B that my sympathies are with bc they cannot go part-time or get more that 6 week maternity leave. So please buckle up or seek help, I don’t think your logic makes sense.
I tend to agree that suicidal thoughts borne out of frustration is totally crazy. Look at the Irish. They are illegals, yet they go to capitol Hill and themselves talk to lawmakers. And then probably in the evening, they might have drunk to that. Do you think they think like that...?:
Yes, if suicide is something that crosses your mind due to GC frustration, I think you need to seek professional help from a therapist. Because mental health is of higher priority than immigration status.
Putting off raising a family, having kids etc UNTIL you get GC is also not wise. Do you really want to tie that important decision of life with the process that's decided in the halls of congress?
Another thing...if you are from India and China, then I suggest you do this. Go to Barnes and Noble, and pick up one of the two books (or both).

Both are written on how hundreds and even thousands of US citizens(Citizens, not GC holders) are going back to their home countries after living in USA because home offers same opportunities in addition to being a the place where you grew up. For all those waiting for approval, its does help to find out if a visa number has been requested for your application. My understanding is that all the applications which are ready for adjudication are moved to a separate area and visa number is requested for those.Infact if you can find out (I think the guys at Infopass only have access to that information. Not sure if the level 2 service does) it helps. If a visa number has been assigned or requested for your application it will get approved.
I am not sure if assigned to an officer or with an officer status has any material value when it comes to approval unless a visa number has been requested.
You might be right. Check the response senator got from USCIS on Aug 6th. I was later approved on Aug 16th.

We are generally processing about 4000 employment-based cases a month and the cases with available visas are being pulled through these sweeps.

Folks...I was told once by an IV core member ' This is the land of the fearless' and therefore we should not fear abut simple things like like sharing our email ID or ph#.
However, keeping this concern in mind that may prevent some members from supporting, i have removed the email ID and ph# column from the public spreadsheet. I will maintain a separate spreadsheet with list of email ID's and ph# so that we can get in touch as soon as it is time for some real action.

Since you consider that IV did nothing to reverse July 2 VB, why are you hanging around here? If you credit AILA/AILF why don't you write to them to file Class Action against USCIS to process case FIFO? They might do it or they might just laugh it off
I would say the reversal of the July 2 visa bulletine didn't just happen because of the flowers the members sent, the law suit AILA wanted to file against USCIS was one of the major reason apart from the California's Lawmakers letter. So please don't try to cut peoples idea by trying to belittle them, if you don't agree with them it is ok, if everyone agreed on the same thing life will be so dull.

I've seen some posts here and people complaining that the GC process has a stranglehold on their lives.
I've been struggling for the GC for the simply reason that my wife can work. Now she's finally a qualified dentist and someone is sponsoring her visa. She could have worked in the last 5 years .. as an assistant and made money .. and done some work. But since I did not have an EAD for her .. that wasn't possible.
But our lives were not held ransom by the GC process. We travelled a lot .. pretty much have seen more of this country than even the natives :). Read, watched movies, socialised .. I think to a large extent we had a lot of fun. Agreed that the process is painful.. and you are held hostage.
But at the end of the day it is your life ..
Simple options are:
1. Wait .. since there is no other alternative
2. Push through IV activities .. so that you are involved
3. Check some other country ..
4. Go back to India. (not saying in a bad way)
At the end of the day .. peace of mind is more important.
The only reason 99% of the people are here is becuase 1$=44.5Rs.
Had it been 1:1.. I would be on the next flight back home .. enjoying family, friends, bhelpuri, cricket , 10000 festivals, neigbors trooping in .. etc etc .
There are always answers.

Got my EAD (the actual card ) and the AP today in the mail. Details are as follows:
EB2 India - Filed Sept 06
140 Approved by TSC in Apr 07
485/EAD/AP Filed on July 2nd at NSC (R Williams 9 :02 am)
LUD on 140 - 08/05
Recd EAD and AP - 09/06
Have not received 485 receipt or FP notice. EAD and AP are from CSC - I recide in CA.
